SportsClub Competition Terms and Conditions:

Definitions:

“The Company” shall mean Realm Communications Ltd or any of its subsidiaries.
“Service” shall mean SportsClub, which offers Content and Competition to Subscribers.
“Content” shall mean the Sporting News sent to Subscribers mobile phones approximately every 5 days
“Competition” shall mean the offering of a chance to win a Prize through a test of skill as described in the Terms & Conditions.
“Subscriber(s)” shall mean any person/individual who subscribed to SportsClub by answering a question correctly via a web-site or via SMS promotion.
“Winner(s)” shall mean any person/individual who has been awarded a Prize by Realm and who has passed the required skill test.
“Prize(s)” shall mean the item of value offered in advertising for the Service. The definition and interpretation of Prize shall be strictly that defined by Realm, its Directors and agents and, in the event that any ambiguity is found to exist in respect of the word Prize, the final decision as to its actual meaning shall be made solely by Realm, its Directors and agents and any such definition shall be accepted by Winners without reservation.

Terms and Conditions:

Subscribers must ensure that their mobile phone is WAP enabled.

Subscribers must be 18 years of age or over to subscribe to the Service. Proof of age may be required to claim Prizes. Failure to provide proof of age within 7 days of being requested to do so may result in Prizes being permanently withheld.

Content (sporting news) is sent to Subscribers' mobile phones, approximately every 5 days. This Content is sent via WAP and it is the Subscriber's responsibility to ensure that their mobile phone is WAP enabled. The Company accepts no responsibility for Content which fails to deliver due to mobile phone not being WAP enabled. WAP charges apply for accessing Content.

It is a condition of entry to the Service that Winners of the Competition shall allow their full names and addresses to be published by Realm, through any media, including SMS transmissions, along with details of the Prizes won.

Winners must pass a skill test in order to obtain Prizes. This shall usually (but not exclusively) be in the form of a general knowledge question sent via SMS or WAP to Subscribers, and maybe subject to change by instructions from the premium Regulator, ComReg. Competition question is sent via SMS or WAP, Subscribers must submit their answer within 24 hours of question being posed. The Company then picks a mobile number at random from the list of numbers who submitted the correct answer and awards the Prize to the Winner.

In respect of the Prize of “two tickets to a sporting event” certain conditions and restrictions apply. These are: The Prize shall be regarded as having been properly awarded if it is fulfilled within one year of the date of the Winner being selected. Winners must the tickets for the dates stipulated by the The Company. The Company, its Directors and agents, shall not be held responsible in any way for any damage or loss suffered by Winners during the sporting fixture. Winners are advised that this is an express condition of acceptance or Prize and agree to indemnify The Company, its Directors and agents against any and all damages or losses incurred as a result of accepting the Prize.

Certain categories of people are excluded from subscribing to the Service. They are: any companies and individuals associated with The Company, or related companies or individuals, their families, friends and close acquaintances, including live-in partners. Also, contractors and/or sub-contractors, or persons directly supplying services in connection with the Service, their families, friends and close acquaintances, including live-in partners.

The Directors of The Company reserve the right to permanently withhold Prizes from individuals whom they have reasonable grounds to suspect may be in breach of this exclusion.

The Directors of The Company shall not accept responsibility for equipment failures, power outages, software failures, electrical or electronic failures, network outages, or other events outside of their control, which may lead to an inability to provide Content and award Prizes within certain time frames, or at all. Claims in respect of such problems, or their related consequences, shall not be entertained, and in that regard Subscribers are advised that they enter the Service at their own risk. In addition, The Company reserves the right to alter, suspend or terminate the Service at its discretion, and without notice. If such alteration, suspension or termination shall occur, The Company shall, at its sole discretion, replace the Prize with a cash or other alternative Prize. Any such alternative Prize shall be equal to or greater than the cost to The Company of providing the Sports Prize.

Prizes shall only be awarded to Winners who provide their correct names, and contact information. It is the Winner’s responsibility to ensure that such details are correct. The Company shall not accept responsibility for non-payment or non-awarding of Prizes due to an inability to process contact details provided by Winners.

The promotion and awarding of the Prize of tickets may be replaced at any time by an alternative Prize. Subscribers agree to accept any such substitution as required.

The Company shall endeavour to contact prospective Winners within 7 working days of their allocation. However The Company shall not be held responsible for an inability to contact Winners or award Prizes due to circumstances outside of its control.

Winners who accept Prizes agree, as a condition of entering the Service, to take part and cooperate with any publicity event required by The Company to promote the Service.

It is the Subscriber’s responsibility to ensure that they are fully aware of and completely understand these Terms & Conditions. Subscribers who enter the Service are confirming that they have read these Terms and Conditions, that they have understood them, and that they have agreed to be bound by them; they also confirm that they have positively opted in to receive the text messages required to take part. The cost of this Service is €6 every 5 days approximately (billed at €2 per message received). Subscribers also confirm that they are opting in to receive free SMS alerts in the future in connection with any of The Company’s services, or those of its associated companies. Subscribers have the right to unsubscribe from the Service at any time, free of charge, by sending the word 'stop' to 57700 or other such shortcode as may be used from time to time.

The Company may refuse to award Prizes, or may not honour Prizes already awarded, in the event that said Prizes were obtained as a direct or indirect result of fraud, dishonesty or non-entitlement to participate in the Service under the Terms & Conditions, or as a result of failure by the Subscriber to adhere to the Terms & Conditions specified herein. This condition shall also apply to Subscribers who obtain Prizes through the unlawful, and/or unauthorized use of a telephone (mobile or fixed line) of which they are not the registered owners and/or bill payers. In special circumstances, if so requested by the relevant Network Operators, and/or by ComReg, Prizes may be with-held pending the resolution of issues pertaining to unauthorized telephone usage.

To the fullest extent permitted by law, the Directors of The Company reserve the right to amend these Terms & Conditions, change, or terminate the Service at any time, details of which amendments, changes or termination, shall be published and shall be applicable as from the date of such publication (publication shall also mean the transmission to relevant individuals of an SMS/WAP message).

It is the responsibility of the customer to inform The Company if they change/cancel their mobile telephone numbers. Subscribers should note that by proceeding to enter the Service they must agree to receive free informational SMS texts from Realm in respect of all its premium rate services - text or voice based - and are proactively and positively opting in. However Subscribers have the right to opt out at any time free of charge by texting 'stop' to 57704, or any other keyword or shortcode which is specified.
